Professional
battery disposal

Manufacturers, distributors and importers of disposable and rechargeable batteries are required to register with stiftung ear and properly dispose of disused batteries and rechargeable batteries. We would be happy to help you meet your legal obligations and keep the reusable materials from your disposable and rechargeable batteries circulating in the closed loop system.

German Batteries Act

The Batteries Act (BattG for short) entered into force in Germany in 2009. It implements the European Battery Directive (BATT) to regulate the placement on the market, take-back and environmentally sound disposal of disposable and rechargeable batteries. Because each country in the EU has its own batteries legislation, the BattG only applies in Germany. The aim is to increase the take-back rate of disposable and rechargeable batteries by implementing the legal obligations in the act. Reusable materials contained in the batteries can be returned to a closed loop via recycling processes, and substances that are hazardous to health and the environment can be disposed of in a professional manner.

Which products are affected by the BattG?

The Batteries Act affects both disposable batteries (primary batteries) as well as rechargeable batteries (secondary batteries) that are either placed on the market as such or are permanently installed. Batteries are broken down into three classes: industrial batteries, vehicle batteries and portable batteries.

To whom do the legal obligations in the BattG apply?

The obligations in the BattG apply to companies whose business involves the initial placing on the market of disposable or rechargeable batteries in Germany. In addition to production, this also includes imports and the sale of own brands. These companies are considered manufacturers and must register as such in the stiftung ear battery register for all battery brands and types of batteries they place on the market in Germany. The same applies to foreign suppliers without a registered office in Germany.

What are my obligations
under the BattG?

Manufacturers and initial distributors of batteries must provide for their take-back and ensure they are professionally disposed of. A take-back obligation for waste batteries also applies for retailers who offer batteries for sale. Manufacturers of portable batteries have to be part of a take-back system that operates throughout Germany. Disposable and rechargeable batteries must also be correctly labelled and include mandatory information that can be clearly identified by end consumers. Special labelling requirements apply for batteries with hazardous substances.

Registration with stiftung ear must be completed before a company places disposable or rechargeable batteries on the market in Germany for the first time. In addition, the volumes of disposable and rechargeable batteries placed on the market must be reported to a take-back system, for example the Stiftung GRS Batterien foundation. The Batteries Act allows manufacturers to employ third parties like Zentek in order to fulfil the relevant legal requirements. Stiftung ear has also recognised us as an authorised representative, which means we are authorised to carry out all tasks on behalf of foreign manufacturers in Germany.
